Welcome to Nutrivio ("we," "our," "us," or "Company"). These Terms of Service ("Terms") govern your use of the Nutrivio mobile application ("App") and related services available on iOS App Store and Google Play Store ("Services").

1.1 Binding Agreement

• By downloading, installing, accessing, or using our App, you agree to be bound by these Terms
• If you disagree with any part of these Terms, you may not use our Services
• These Terms constitute a legally binding agreement between you and Nutrivio

1.2 Eligibility

• You must be at least 13 years old to use our Services
• Users under 18 must have parental or guardian consent
• You must have the capacity to enter into a legally binding agreement
• Your use must comply with all applicable laws and regulations

2. Description of Services

2.1 Core Features

Nutrivio provides:

• AI-powered food recognition and nutrition analysis
• Personalized meal planning and recipe recommendations
• Nutrition tracking and progress monitoring
• Health and fitness goal management
• Social features for sharing and community engagement

2.2 Service Availability

• Services are provided "as is" and "as available"
• We strive for 99.9% uptime but cannot guarantee uninterrupted access
• Maintenance and updates may temporarily limit availability
• Features may vary by device, operating system, and location

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You must promptly update any changes to your information
• One account per person; multiple accounts are prohibited

3.2 Account Security

• You are solely responsible for all activities under your account
• Notify us immediately of any unauthorized access or security breaches
• Use strong, unique passwords and enable available security features
• We are not liable for losses resulting from unauthorized account access

4. Acceptable Use Policy

4.1 Prohibited Activities

• Violate any applicable laws, regulations, or third-party rights
• Upload harmful, offensive, or inappropriate content
• Impersonate others or provide false information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Services or servers
• Use automated tools or bots without permission
• Reverse engineer, decompile, or hack our App
• Spam, harass, or abuse other users

4.2 Content Guidelines

• Content must be relevant to nutrition, health, and wellness
• No sexually explicit, violent, or discriminatory content
• Respect intellectual property rights of others
• No promotional or commercial content without permission

5. Subscription and Payment Terms

5.1 Subscription Plans

• We offer both free and premium subscription tiers
• Premium features require an active paid subscription
• Subscription prices are displayed in the App before purchase
• Prices may vary by region and are subject to applicable taxes

5.2 Billing and Renewals

• Subscriptions automatically renew unless cancelled
• Payment is charged to your app store account
• Renewals occur 24 hours before the current period expires
• Subscription management is handled through your app store account

5.3 Cancellation

• Cancel anytime through your app store account settings
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused portions of subscription periods
• You retain access to premium features until subscription expires

6. Intellectual Property Rights

6.1 Our Content

• All App content, features, and functionality are owned by Nutrivio
• Protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, or distribute our content without permission
• Any unauthorized use may result in account termination and legal action

6.2 User Content

• You retain ownership of content you create and upload
• You grant us a license to use your content to provide our Services
• You represent that you own or have rights to all content you upload
• We may remove content that violates these Terms or our policies

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• AI recommendations are estimates and may not suit individual needs

• We do not guarantee specific health outcomes or results
• Features may change or be discontinued at any time
• Technical issues may occasionally affect service quality

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months before the claim
• We are not responsible for third-party content or services
• You use our Services at your own risk

10. Indemnification

You agree to indemnify and hold harmless Nutrivio, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of third-party rights
• Your content or conduct

11. Termination

11.1 Termination by You

• You may stop using our Services at any time
• Delete your account through the App settings
• Cancel subscriptions through your app store account

11.2 Termination by Us

• We may suspend or terminate accounts for Terms violations
• We may discontinue Services with reasonable notice
• Serious violations may result in immediate termination
• We reserve the right to refuse service to anyone

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.

12.2 Dispute Resolution

• Most disputes can be resolved through customer support
• For legal disputes, UK courts have exclusive jurisdiction
• Both parties waive rights to jury trials
• Class action lawsuits are not permitted

13. Changes to Terms

We may update these Terms from time to time:

• Material changes will be notified through the App or email
• Non-material changes will be posted with an updated date
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nutrivio.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in full force.

14.3 Assignment

We may assign these Terms to affiliates or successors. You may not assign your rights without our consent.
